Terms of Service

1. Introduction

These Terms of Service ("Terms") govern the use of Polyplan ("the Service"), operated by Virtuele Beleving VOF.

By creating an account, purchasing a subscription, or using the Service, you agree to be bound by these Terms.

If you do not agree with these Terms, you may not use the Service.

3. Description of the Service

Polyplan is a cloud-based software platform that enables real estate professionals to create building plot visualisations and related project presentations.

The Service is provided on a subscription basis and may be modified, updated, expanded, or improved over time.

Virtuele Beleving VOF reserves the right to add, remove or modify features without prior notice.

4. Eligibility

You must be at least 18 years old and legally capable of entering into contracts to use the Service.

By using Polyplan, you represent that you meet these requirements.

5. Subscription and Billing

Access to Polyplan is provided through a recurring monthly subscription.

Current pricing: €19 per month excluding applicable VAT.

Payments are securely processed through Paddle.

Subscriptions automatically renew unless cancelled before the next billing date.

Virtuele Beleving VOF reserves the right to modify pricing in the future. Existing customers will be notified before any pricing changes take effect.

6. Cancellation

Customers may cancel their subscription at any time. Upon cancellation:

  • No future payments will be charged.
  • Access remains active until the end of the current billing period.
  • No partial refunds are provided for unused subscription periods.

7. User Accounts

Users are responsible for:

  • Maintaining the confidentiality of login credentials.
  • Ensuring information provided is accurate.
  • All activities performed through their account.

Multiple employees within the same real estate office may use the Service. Sharing access with external companies, competitors, third parties or other real estate offices is not permitted.

8. Acceptable Use

Users may not:

  • Use the Service for unlawful purposes.
  • Attempt to gain unauthorized access to systems or data.
  • Reverse engineer, copy, modify or resell the software.
  • Interfere with platform security or availability.
  • Upload malicious software, viruses or harmful content.

Virtuele Beleving VOF may suspend or terminate accounts that violate these rules.

9. Intellectual Property

All intellectual property rights related to Polyplan remain the exclusive property of Virtuele Beleving VOF. This includes but is not limited to:

  • Software
  • Source code
  • Algorithms
  • Platform design
  • Databases
  • Branding
  • Workflows
  • Documentation

No ownership rights are transferred to users.

10. Customer Content and Generated Output

Customers retain ownership of their own project data.

Customers receive a non-exclusive, perpetual licence to use visualisations generated during an active paid subscription period.

Generated visualisations may continue to be used after subscription cancellation. However, customers may no longer generate new visualisations after access to the platform ends.

11. Marketing and References

Virtuele Beleving VOF will never use customer projects, visualisations or data for marketing purposes without explicit permission from the customer.

12. Accuracy Disclaimer

Polyplan provides visualisations for illustrative and presentation purposes. Generated visualisations are indicative only.

Virtuele Beleving VOF does not guarantee:

  • Correct dimensions
  • Parcel boundaries
  • Building regulations
  • Urban planning compliance
  • Technical feasibility

Users remain solely responsible for verifying all information before making business, legal or construction decisions.

13. Availability

Virtuele Beleving VOF aims to provide reliable access to the Service. However, uninterrupted availability cannot be guaranteed. Temporary interruptions may occur due to:

  • Maintenance
  • Technical issues
  • Infrastructure failures
  • Third-party service disruptions

14. Limitation of Liability

To the maximum extent permitted by law, Virtuele Beleving VOF shall not be liable for:

  • Indirect damages
  • Consequential damages
  • Loss of profits
  • Loss of business opportunities
  • Loss of data
  • Decisions made based on generated visualisations

The total liability of Virtuele Beleving VOF shall never exceed the subscription fees paid by the customer during the twelve months preceding the claim.

15. Data Retention

Project data and account information may be retained for up to 12 months after subscription termination to allow account recovery and reactivation.

After this period, data may be permanently deleted unless legal obligations require longer retention.

16. Suspension and Termination

Virtuele Beleving VOF reserves the right to suspend or terminate accounts in cases of:

  • Fraud
  • Abuse
  • Security threats
  • Violation of these Terms
  • Activities that negatively affect platform stability

17. Changes to these Terms

Virtuele Beleving VOF may update these Terms periodically. The most recent version will always be available on polyplan.be.

Continued use of the Service constitutes acceptance of the updated Terms.

18. Governing Law

These Terms shall be governed exclusively by Belgian law. Any disputes shall be submitted to the competent courts of Belgium.
